A lady from Arkansas is suing 96 defendants in Madison County Circuit Court. Tammy Schwartz, who is a mesothelioma patient, accuses that she was exposed to airborne asbestos fibers from her husbands' and father's clothing.
Mrs Schwartz says that her current husband Joseph Schwartz is a pipe fitter and electrician at various locations and former husband was doing his own automotive maintenance on family vehicles. Her father was working as a heavy machine operator from 1954 through 1995.
According to the claim of Schwartz, her family members were working with and around products containing asbestos. They would carry the deadly asbestos fibres on their clothing home with them where it would again become airborne.
Mrs Schwartz was diagnosed with mesothelioma on April 18, 2006.
"Dust created by working with and around asbestos and asbestos-containing products would permeate the person and clothing of the plaintiff's family members. This dust contained asbestos fiber," Mrs Schwartz said.
The complaint states that Mrs Schwartz was repeatedly exposed to this asbestos dust from her family member's person and clothing.
Mrs Schwartz also alleges that she was exposed to asbestos during some non-occupational projects such as home and automotive repairs, maintenance and remodeling.
According to the allegation, 96 defendant corporations are responsible for her present situation with an intentional or reckless disregard for her safety.
Schwartz is expecting compensatory damages in excess of $200,000 in addition to punitive damages.
