15-Feb-2007 Three employees who had been accused of illegally disposing asbestos wastes in public places pleaded not guilty or stood mute against the charge on Monday. The allegation was that they unloaded hundreds of gallons of asbestos waste near a school and a subdivision.
Dennis P. Szulborski, Sean V. MacLean and Stephen Day are the three convicts who appeared for a pretrial before Mark S. Switalski, the Macomb County Circuit Judge on a 5-year misconduct charges. Szulborski is the boss of Day and MacLean. Switalski has set a final pretrial date for the group. It will be on March 1. However, the attorneys told that some of the defendants might not have to stand the hearing.
Jeff Burns, an attorney at Monday's hearing said, "We're still talking about a possible plea or some kind of resolution to this case. Nothing solid has been worked out, but we're still open to discussion."
It was in late 2003 that the Washington Township found two vacant lot sites with hundreds of gallons of asbestos waste - one along Jewell Road across from Powell Middle School, and another on Hidden Oak Lane in a housing subdivision. Because of the adjacency to Powell Middle School, the Michigan Department of Environmental Quality had to immediately remove the waste before finding out the hands behind the crime.
The later investigation by the Macomb County Health Department made it clear that it was 'Allied Environmental', a Shelby Township-based asbestos removal company run by Szulborski, that acted behind the dumping of the hazardous substance. Their conclusion was based on the markings on the containers.
This has been evidenced from a security videotape of the facility as well, which clearly showed the two employees who appeared to be unloading the casks. Officials are sure that those workers were Day and MacLean. The company president is not there on the tape, however the accusation is that as the company owner, he was aware of these efforts of his subordinates.
The expense for the removal of asbestos was above $10,000 and the officials hope this to be retrieved in the court from the company.
